The first step in recovering unpaid rent is usually a Letter Before Action – a formal legal letter that gives your tenant one final opportunity to pay before court action begins. Often, this is enough to encourage payment and avoid further steps. 

Court Claims for Rent Arrears 

If the rent still isn’t paid, we can issue a money claim through the County Court. We handle everything from preparing the claim to obtaining a County Court Judgment (CCJ), which confirms that your tenant owes the money. 

Enforcement of Judgments 

Once a judgment is in place, we can take steps to enforce it. These include: 
 
Warrants of Execution – authorising enforcement agents to collect payment or seize goods 
Attachment of Earnings Orders – deducting payments directly from a tenant’s salary 
Charging Orders – securing the debt against the tenant’s property (if they own one) 
Statutory Demands & Bankruptcy Proceedings 
 
In more serious cases, we can serve a statutory demand as a formal warning before pursuing bankruptcy proceedings. This is a powerful tool if the arrears are significant and the tenant has assets. 

Evicting Tenants in Rent Arrears 

If the situation can’t be resolved, we’ll help you start possession proceedings under Section 8 of the Housing Act, which allows you to evict tenants based on rent arrears.
